SALINAS, California- Monterey County District Attorney Jeannine M. Pacioni announced on Tuesday, July 27 that on July 15, 2021 the court approved a property in Bradley, California for 68-year-old Sexually Violent Predator Jorge Rubio’s supervised release. Rubio was convicted of multiple sex offenses against children in the 1980s and 1990s for which a jury subsequently designated him a sexually violent predator resulting in his indefinite commitment to a state hospital. In September of 2006 following his prison sentence, Rubio was transferred to Coalinga State Hospital where he remains today. In December 2019, the state hospital recommended supervised release pursuant to Welfare and Institutions Code section 6608. Although the state hospital found Rubio is still a sexually violent predator, it concluded that his treatment has progressed such that he is unlikely to reoffend while under supervision and treatment in the community. In September of 2020 the court held a hearing on the matter at which representatives from the state hospital and Liberty Healthcare—the agency tasked with supervising Rubio upon his release—testified about the recommendation. In October of 2020, following closing arguments during which the District Attorney’s Office objected to Rubio’s release, the court followed the state hospital’s recommendation and granted supervised release. In March of 2021, Liberty Healthcare noticed a proposal for Rubio’s community placement in Bradley, California. In April of 2021, the court initiated a series of public comment hearings regarding the proposal. Following an investigation of the property by the Sheriff’s Office including dozens of public comments written by concerned community members, the court approved the property for Rubio’s release. The court ordered that Rubio be released to a representative from Liberty Healthcare for transportation to his new residence in Bradley, California by the end of July 2021. Rubio will be subject to detailed conditions of release overseen by Liberty Healthcare, including, but not limited to, sex offender registration, GPS monitoring, travel restrictions, relevant stay away orders, curfew, polygraph tests, random visits and searches, computer and social media supervision, continued sex offender treatment, and drug and alcohol treatment and monitoring. If Rubio violates his conditions of release, he may be returned to the state hospital.
