Man Shot by Police outside of Gonzales Charged with 3 Counts of Attempted Murder of a Police Officer

SALINAS, California- Monterey County District Attorney Jeannine M. Pacioni announced on Friday, December 20 that the subject of an officer involved shooting, which occurred on the evening of Wednesday, December 11, 2019 at 28715 Old Stage Road in Monterey County, has been charged with 3 counts of attempted murder of a police officer, felony evasion of a police officer, and being a convicted felon in possession of a firearm, a felony.
At about 8:24 p.m., Salinas police officer Evan Adams attempted to stop 42-year-old Daniel Macias Victoria for vehicle code violations within the city limits of Salinas. Officer Adams activated his emergency lights and siren, but Victoria failed to yield. He led several officers, driving marked patrol cars, on a pursuit. During the pursuit, Victoria fired a handgun twice at Salinas police officer Daniel Garcia who followed immediately behind him in a marked patrol car. The first time, Victoria reached out the driver’s window of his truck and pointed the barrel of the handgun towards Officer Garcia and fired. The second time, seconds after firing the first shot, he pointed the handgun out the open back window of his truck and fired again towards Officer Garcia. The pursuit ended when the vehicle driven by Victoria stopped in a muddy field.
Police officers, including a sheriff’s deputy and a Gonzales police officer, established a perimeter around Victoria, who remained inside his truck. The officers issued commands to Victoria to come out with his hands up. Victoria called dispatch demanding to speak with a specific sergeant or else he would start shooting. Minutes later, Victoria pointed his handgun out the driver’s side window and fired a shot towards the police officers. They immediately returned fire, striking Victoria with five rounds. After the exchange of gunfire, they recovered a .45 caliber semiautomatic handgun immediately next to the driver’s side of Victoria’s truck.
Due to Victoria’s injuries, no arraignment is currently scheduled. Because the District Attorney’s Office has commenced a prosecution in this case, further details are available only when made in public court proceedings.

On July 5, 2024, Parks staff noticed that dead baitfish, mostly shad, began washing up on the shore around Lake San Antonio and immediately contacted California Department of Fish and Wildlife (CDFW) to report the situation. At that time, the CDFW fisheries biologist stated the fish die off was most likely due to the high temperatures and low dissolved oxygen level in the water and that the situation most likely did not present a risk to the public. Parks staff also contacted the Water Resources Agency (WRA), State Water Resources Control Board and Environmental Health Bureau.   Unfortunately, the fish die off has continued with larger species such as bass, catfish, crappie, carp, and trout being impacted. Attached photos include a 3–4-pound bass.   CDFW, WRA and EHB are working together to try to determi
